Janice P. Oviatt Attorney serving Harris and Surrounding Counties
I am Janice P. Oviatt, a Houston based attorney dedicated to giving clients diligent legal representation in the areas of immigration, criminal and collaborative family law. I also offer my services as a consultant to members of the Family Bar and Criminal Bar when questions or issues relating to immigration law arise in their client's family or criminal case.
Unfortunately, many people believe that immigration law is simply filing out forms. Nothing could be farther from the truth. In the American legal system, this body of law is one of the most complicated and difficult areas to comprehend. I am familiar with and understand the complexities of this system because I have practiced in the immigration field for over 10 years.
If you are seeking a green card, a visa for your fiancee/spouse, citizenship, deportation defense, or have other immigration issues, call my law office for a consultation. I will analyze your case and based on your immigration goal, advise you whether the current U.S. Immigration system will work for you - or against you.
Collaborative Family Law
Collaborative Family Law is a truly different way to resolve family related disputes. Unlike the adversarial approach to domestic issues which can be extremely destructive, fosters hostility, and is riddled with negativity, the collaborative law method is highly constructive, facilitates cooperation, and generates a more positive outcome. Divorce, child visitation, custody, support, modification of existing orders, and paternity are family based legal matters where the collaborative method, rather than the usual adversarial process, may be an appropriate alternative for the parties to consider.
Would you like to know more about Collaborative Family Law? Contact my office and arrange for a consultation. I will assess your current situation and advise whether you are a good candidate for the collaborative family law method.
If you (or a loved one) have been accused of committing a crime, you need information and assistance; information about the criminal justice system and assistance with an unfamiliar, stressful, and usually frightening situation. If you are not a U.S. citizen, you have another essential need - to determine whether there are deportation consequences if you are convicted of the crime you have been accused of committing.
Whether you are a U.S. citizen or an alien, you should not try to represent yourself and/or accept the "good deal" (plea bargain) the prosecutor is offering. Either way, the consequences could be devastating and irreparable. Contact my office for a consultation. I will meet with you, answer your questions and discuss options appropriate for you, based on your individual circumstances.
Criminal Law Attorneys : Are you aware that your non-citizen client may be deported if convicted of not only most felonies, but of certain misdemeanors as well? To which felonies can your alien client safely plea? Which misdemeanors are never safe pleas? Is DAJ a conviction for immigration purposes? Pretrial diversion?
Family Law Attorneys : Your divorce client is a "conditional" resident and the spouse is a U.S. citizen. Are there immigration issues that should be discussed with your alien client? If the situation is reversed and you represent the citizen spouse, is it important for you to understand the alien spouse's immigration status? Your client says to you, "She only married me to get her green card and I want to get her deported." How do you respond?
If you are a family or criminal attorney, it is a certainty that during your law career, either your client or a party to the suit will be a non-citizen. When that happens, if you do not know the answers to these questions, to protect your client and yourself, you should consult with an immigration attorney.
Contact my office. I can advise whether immigration is or could be an issue in your client's case and if so, whether your course of legal representation requires a different approach. I offer a variety of consultant services and my rates are reasonable.
