Small Business Tax Credit Examples
Emergency Unemployment Compensation (EUC). Effective November 27, 2010, Emergency Unemployment Compensation (EUC) will phase out. This had initially originated from President Obama when he signed a law extending the EUC program and providing full federal funding for state extended benefits.
IRS Form W-2 Reporting Requirement. On October 12, 2010, the Internal Revenue Service (IRS) instituted a one-year delay in the Affordable Care Act (ACA) requirement in order to allow employers to make changes to their payroll systems or procedures in compliance preparation to report the cost of coverage under an employer-sponsored group health plan on Form W-2.
OSHA Penalty Policies. Effective October 1, 2010, all OSHA area offices are directed to utilize the new penalty policy and the associated calculation system. Among the enforcement, the time period for considering an employer’s past history of OSHA violations for purposes of determining a “repeat” violation and determining penalty increases and reductions is expanded from three years to five years. The penalty adjustment factors will be applied “serially” in the order of history, good-faith, “quick fix”, and size.
New Federal Drug Testing Custody and Control Form. Effective October 1, 2010, The Department of Transportation (DOT) has issued an Interim Final Rule (IFR) providing instructions for the new Department of Health and Human Services (HHS) Federal Drug Testing Custody and Control Form (CCF).
Early Retirement Reinsurance Program (ERRP). On September 28, 2010, The U.S. Department of Health and Human Services (HHS) released guidance on claims that are eligible and ineligible for reimbursement under health care reform’s Early Retirement Reinsurance Program (ERRP).
Roth Conversions and Savings Plans. On September 27, 2010, President Obama signed into law the “Small Business Jobs Act of 2010”. This law provides a provision of enabling 401(k) and 403(b) plans (i.e. Savings Plans) to permit participants to convert some or all of their existing pretax amounts into Roth accounts within the existing Savings Plan. This new statutory provision is optional and applies only if a Savings Plan permits participants to make Roth contributions to it. .
